Do I need civil liability protection and personal accident protection.......!!!!! All help appreciated

I jointly run Saturday morning football training for 7 and 8 year olds. It is voluntary and there is no cost to the parents. It is done in association with the school and only children of the school attend. It takes part on the school playing field. The equipment is provided for by sponsors/PTA/parent contributions. Parents must stay 'pitch side' and are in essence responsible for their children should they wander off or hurt themselves.

Do I need any sort of personal insurance / protection in the event of one of the parents suiing me (if little 'Johnny' hurts himself) - I guessed not, as I am not responsible for them, the parents are, however someone has questioned this.

Any legal wizzes no the answer??

Have you heard of Ben Collett?

He was a Manchester United youth player, he suffered a broken leg in a match and as such received a pay out of £4.3 Million

That case was supposed to have set the precedent for sportsman claiming on insurance

Yes. Unless the school are willing to extend their policy over you. That would be the easiest and most cost effective option.

Thanks for the steer. Perhaps I am naive, but how can they sue me when their parents are responsible for them being there. I could understand suing another child / parent for a bad tackle, but the coach who facilitates?

You should speak to the school headteacher about this ASAP... if it is in association with them, then I'm sure they will help sort it out with you - have you done any risk assessments or anything? They are absolutely ridiculous, but you seem to need them for everything these days ...

I don't think their parents are responsible for them, you're the trainer and have full say over what they do on the field so I can't see how the parents can be held responsible personally

I take it you have all the correct badges to be able to coach them

the training has been going on for years and years, we have 4 years and about 100 kids. The school appear to know nothing?

You should have liability insurance & be CRB checked. Have you registered with the FA ? If you've at least got your Level 1 coaching badge they should have given you this information already and should keep you up to date on the latest regulations (Spot the wife of someone who coaches in his spare time ). Also, my OH uses a school for one of his coaching sessions (but he charges subs) but the school is not liable for any accidents etc - he is just hiring their land if you like.

100 kids, how many coaches do you have?

I'm sure you have to have 1 coach per x children (maybe sigma knows better)

Your a court case waiting to happen mate, i'd definitely sort something out if I were you especially if parents are starting to question it

we have all been crb checked. we are only parent volunteers - we do not earn from it - just helping the kids learn to play football and have some fun. the parents are there all the time and choose to come and remain responsbile for them. the ratio is about 1 to 11. some have got level 1 coaching badges some haven't. the school is an fa standard charter school. to date none of the parents have raised it apart from one - i thought she was being a busy body, but perhaps she has a point. she seems to think that by being an fa coach 1 you automatically get the pl insurance but i cannot see this anywhere on the fa#s website

I'll have a quick word with OH when he gets in as he runs a number of teams in his spare time & is currently getting UEFA B qualified (L3). Can only give very general guidance obviously, but I'll see if he has any relevant advice

I fear you will be liable, there are some many laws in concern of child protection, and personal liability, did you know that a property owner owes a duty to trespassers.

Please speak to a solicitor (pro bono) or even citizen advice, As Lord Atkins (a judge on a case that caused a major precdent in law of tort, ie liability, stated within the infamous case of Donoghue v Stevenson updated via Dickman v Caparo The neighbour principle in the law of Tort)
"You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Who, then, in law, is my neighbour? The answer seems to be—persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation as being so affected when I am directing my mind to the acts or omissions that are called in question".

I could be wrong, but legal advice is warranted here, as those you have a relationship with or for example in close proximity to you and you know them, and a accident happens which you possibly could of foreseen, you may be liable?

Thanks, you can only get the faca cover if you are at least level 1 fa qualified. some of our coaches are not. seems like the school needs to sort it.
